Payment Terms

  • All fees are quoted in Euros (EUR) unless otherwise specified
  • Late payments may incur additional charges as specified in your agreement
  • We reserve the right to suspend services for non-payment

Limitation of Liability

To the maximum extent permitted by law, digitalnovaes shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business interruption, arising from your use of our services.

Our total liability for any claims arising from or related to our services shall not exceed the amount paid by you for the specific service giving rise to the claim in the twelve months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

Indemnification

You agree to indemnify and hold harmless digitalnovaes, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Norway. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the Norwegian courts.

If you are a consumer resident in the European Union, you may also have the right to bring proceedings in the courts of your country of residence.

Termination

Either party may terminate the service relationship with reasonable notice as specified in your service agreement. We may immediately terminate or suspend access to our services if:

  • You breach these Terms or any service agreement
  • You fail to pay fees when due
  • We reasonably believe termination is necessary to protect our interests or those of other users
  • Required by law or regulatory authority

Upon termination, your right to use our services will cease immediately, and we may delete your data in accordance with our data retention policies.

Force Majeure

digitalnovaes shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labour disputes, or government actions.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.

Entire Agreement

These Terms, together with any service agreements and our Privacy Policy, constitute the entire agreement between you and digitalnovaes regarding the use of our services and supersede all prior agreements and understandings.

Amendments

We may modify these Terms from time to time. We will notify you of material changes by posting updated Terms on our website or by email. Your continued use of our services after such notice constitutes acceptance of the modified Terms.
